1. INTRODUCTION

White Gloves Lux Services, LLC (hereinafter White Glove”, “We”, “Our” and/or “Us) respect your privacy and are committed to protecting it through our compliance with this policy (hereinafter “Privacy Policy”).

This policy describes the types of information we may collect from you or that you may provide when you visit and utilize White Glove’s mobile phone application and our practices for collecting, using, maintaining, protecting, and disclosing that information. Specifically, this Privacy Policy explains how White Glove uses, collects, and shares information from both White Glove’s users (hereinafter “Users”), White Glove’s drivers and operators of motor vehicles or any other medium of transportation, which shall include boats, cars, and bicycles, used on behalf of White Gloves (hereinafter “Drivers”), and all those other parties that shall either utilize White Glove’s mobile phone application or perform services on behalf of White Glove. This Privacy Policy shall apply to all those Users of White Glove’s services and Drivers, anywhere at any time, including those whom access White Glove’s apps, website features, or other services. Aside from this Privacy Policy, Users and Drivers are also subject to White Gloves Terms and Conditions, which are incorporated and made a part of this Agreement (SEE LINK).

2. SCOPE OF PRIVACY POLICY

This Privacy Policy applies to information we collect as more fully described herein:

  1. On White Glove’s website;
  2. In connection with White Glove’s services;
  3. In email, text, and other electronic messages between Users, Drivers and White Glove;
  4. Through White Glove’s mobile phone application;
  5. When Drivers and Users interact with our advertising and applications on third- party websites and applications, if those applications or advertising include links to this policy; and
  6. ANY OTHER SOURCES.

This Privacy Policy does not apply to information collected by:

  1. White Gloves Lux Services, LLC, offline or through any other means, including on any other Website operated by any other Company or any third party (including our affiliates and subsidiaries); or
  2. Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on White Glove’s website and mobile phone application.

This Privacy Policy applies to the following persons:

  1. Users: users who request or receive transportation;
  2. Drivers: users who provide transportation individually or through partner transportation companies;
  3. Delivery Affiliates: Users who provide delivery services;
  4. Service Recipients: those who request services through White Glove’s mobile phone application or website.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use White Glove’s Website or Mobile phone application. By accessing or using White Glove’s website or mobile phone Application, you agree to this Privacy Policy. This policy may change from time to time. Your continued use of White Glove’s website or mobile phone application after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

3. INFORMATION WE COLLECT ABOUT USERS AND DRIVERS AND HOW WE COLLECT IT

We collect several types of information about Users of our website and Mobile Phone Application along with Drivers, including, but not limited to: name, postal address, e-mail address, telephone number, the equipment Users and Drivers use to access White Glove’s website or mobile phone application and usage details. We collect all this information directly from Users and Drivers when you provide it to us, automatically as you navigate through and use White Glove’s mobile phone application. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies from third parties, for example, White Glove’s business partners.

4. INFORMATION USERS AND DRIVERS PROVIDE TO WHITE GLOVE

The information we collect on or through White Glove’s website and mobile phone application may include:

    1. REGISTRATION. Information that Users and Drivers provide to White Glove when initially registering to use our mobile phone application and/or website. This includes information provided at the time of registering and subscribing to White Glove’s services including, but not limited to, name, e-mail address and phone number. White Glove may also ask you for information when you report a problem with our mobile phone application and/or website.
    2. RECORDS. Records and copies of your correspondence (including email addresses), if you contact White Glove.
    3. RIDES. Details of transactions Users and Drivers carry out through White Glove’s website and mobile phone application and of the fulfillment of your rides with White Glove.
    4. PAYMENT METHOD AND INFORMATION. Upon initially registering for White Glove’s services Users will be required to provide payment information in the form of a credit card for services to be rendered by White Glove’s Drivers and there may be a third-party that will handle Users credit card information provided to White Glove. However, in order to ensure that all payment information provided by User is kept secure this payment information will not be stored on our servers or retained for any other purpose except as set forth in this Privacy Policy.
    5. USER PROFILE. Upon the creation of your user account with White Glove we will collect certain information from Users and Drivers that may include name, address, phone number, birth date, government ID number, financial and banking information, photograph (for Drivers) and signature. Drivers will be required to provide vehicle information including insurance information for their vehicle and make, model and year.
    6. BACKGROUND CHECKS FOR DRIVERS. In addition to the information provided as mentioned in this section there is other information that may be required to be collected from Drivers in order to complete registration as a Driver as this information may include name, physical address, social security number, vehicle information, car insurance information, and driver’s license information.

5. INFORMATION WE COLLECT WHEN USING WHITE GLOVE’S MOBILE PHONE APPLICATION AND WEBSITE

As you navigate through and interact with White Glove’s website and mobile phone application, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

    1. LOCATIONS. In order for White Glove to provide services to Users and Drivers they will be required to obtain certain information in order to know what Users and Drivers current location is. Specifically, White Glove will need to collect Users and Drivers precise location through the Global Positioning System on your mobile device or WiFi. This is necessary to allow Drivers to Determine Users exact location and allow the drop off/pick up process to be more efficiently completed along with allowing for the calculation of fees and charges. The White Glove mobile phone application may be used without allowing White Glove to access your location through your mobile device. However, this will result in the mobile application and pick up/drop off process to function in a less efficient manner.
    2. DEVICE INFORMATION. In order for White Glove to effectively render services for Users and obtain Users locations White Glove will be required to access certain information on your mobile device including your IP address, web browser type, mobile operating system version, phone carrier and manufacturer, application installations, device identifiers, mobile advertising identifiers, push notification tokens.
    3. USAGE INFORMATION. In order to ensure that White Glove is responsive to the needs of their Users we may automatically collect information about Users interactions with the White Glove mobile phone application including the content you view and pages you visit.
    4. RATINGS SYSTEM. In order for White Glove to ensure their Users and Drivers’ experiences with our services are optimal both Users and Drivers may be able to rate and review each other at the end of every ride and these ratings will be visible to other White Glove Users and Drivers.
    5. CALL AND TEXT INFORMATION. White Glove will work with third party companies to facilitate phone calls between Users and Drivers who may utilize the White Glove mobile phone application to connect for a ride and White Glove receives information about these communications and White Glove, for security purposes, may monitor calls made using the White Glove mobile phone application, namely calls between Users and Drivers. White Glove will notify you that the call is being recorded and will proceed if you agree to such recording.
    6. ADDRESS BOOK. White Glove may access Users and Drivers address book if permitted by Users and Drivers in order to facilitate invitations and social interactions that you initiate using our Mobile Phone Application and other purposes described herein.

White Glove also may use these technologies to collect information about your online activities over time and across third-party websites, mobile applications and other online services (behavioral tracking).

The information White Glove collects automatically includes statistical data and may include personal information, we may maintain it or associate it with personal information White Glove collects in other ways or receive from third parties. It helps us to improve our website and mobile phone application and to deliver a better and more personalized service, including by enabling us to:

  1. Estimate White Glove’s audience size and usage patterns;
  2. Store information about Users and Drivers preferences, allowing us to customize our mobile phone application according to Users and Drivers individual interests;
  3. Recognize Users and Drivers when you return to White Glove’s mobile phone application.

The technologies White Glove uses for this automatic data collection may include:

  1. COOKIES (OR BROWSER COOKIES). A cookie is a small file placed on the hard drive of your computer or on your mobile device, which will allow White Glove to collect certain information of Users and Drivers. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of White Glove’s website and mobile phone application and certain features. Unless Users and Drivers have adjusted their browsers or devices setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website or Mobile Phone Application.
  2. FLASH COOKIES. Certain features of White Glove’s website or mobile phone application may use local stored objects (or flash cookies) to collect and store information about your preferences and navigation to, from, and on our website or mobile phone application. Flash cookies are not managed by the same browser settings as are used for browser cookies.
  3. WEB BEACON. Pages of White Glove’s website or mobile application and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit White Glove, for example, to count Users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website and application content and verifying system and server integrity).

6. THIRD-PARTY USE OF COOKIES AND OTHER TRACKING TECHNOLOGIES

Some content or applications, including advertisements, on White Glove’s website and mobile application are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about Users and Drivers when you use our website or mobile phone application. The information they collect may be associated with Users and Drivers personal information or they may collect information, including personal information, about your online activities over time and across different websites and mobile phone application and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

7. HOW WHITE GLOVE USES YOUR INFORMATION

White Glove uses information that we collect about you or that you provide to us, including any personal information to:

  1. Connect White Glove Users to White Glove Drivers;
  2. Analyze and understand how White Glove Users and Drivers navigate White Glove’s platforms and mobile application;
  3. Communicating with Users and Drivers for marketing purposes, including promotions and contests;
  4. Enable communication to or between Users and Drivers;
  5. Personalize your White Glove experience;
  6. Alert you as applicable through push notification and text messages;
  7. Process transactions and payments;
  8. Provide customer support;
  9. Preventfraudulent activity;
  10. Respond to trust and safety issues that may arise, including auto incidents, disputes between Riders and Drivers, and requests from government authorities.

Additionally, we use the information we collect from Drivers for the following purposes related to driving while on the White Gloves platform:

  1. Sending emails and text messages to Drivers who have started the driver application process regarding the status of their application;
  2. Determining a Driver’s eligibility to drive for White Glove;
  3. Notifying Drivers about ride demand, pricing and service updates; and
  4. Calculating and providing White Gloves’ auto insurance policy and analyzing usage patterns for safety and insurance purposes.

We may use the information we have collected from Users and Drivers to enable us to display advertisements to our advertisers’ target audiences. Even though White Glove does not disclose Users and Drivers’ personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

8. HOW WHITE GLOVE SHARES THE INFORMATION WE COLLECT

White Glove may share the information we collect:

    1. WITH OTHER USERS. For example, Whites Glove Users and White Glove Drivers that have been matched for a ride are able to see basic information about each other, such as names, photo, ratings, and any information they have added to their profiles. Drivers see the pick-up location that the User has provided. Riders see Driver’s vehicle information and real-time location as the Driver approaches the pick-up location. Users’ ratings of Drivers are shared with Drivers. We de- identify the ratings and feedback, but we can’t rule out that a Driver may be able to identify the Rider that provided the rating or feedback. Although we help Riders and Drivers communicate with one another to arrange a pickup, we do not share your actual phone number or other contact information with other Users. If you report a lost or found item to us, we will seek to connect you with the relevant Rider or Driver, including sharing actual contact information with your permission.
    2. BETWEEN WHITE GLOVE AND OUR SERVICE AND BUSINESS

PROVIDERS. White Glove may provide information to its vendors, consultants, marketing partners, research firms, and other service providers or business partners. This may include, for example:

      1. Payment processors and facilitators;
      2. Background check providers (drivers and delivery partners only);
      3. Cloud storage providers;
      4. Marketing partners and marketing platform providers;
      5. Data analytics providers;
      6. Research partners, including those performing surveys or research projects in partnership with White Glove or on White Glove’s behalf;
      7. Vendors that assist White Glove to enhance the safety and security of its apps;
      8. Consultants, lawyers, accountants and other professional service providers;
      9. Fleet partners;
      10. Insurance and financing partners;
      11. Airports;
      12. Restaurant partners; and
      13. Vehicle solution vendors or third-party vehicle suppliers.
      1. BETWEEN WHITE GLOVE AND THIRD PARTIES. White Glove may allow you to connect with other websites, products, or services that White Glove does not have control over (for example, we may give Users the ability to order a food delivery from a restaurant from within the White Glove app). If you use these services, we will provide the third party with information about Users to allow them to provide the service to you (for example, we would give the restaurant your name, phone number and address to drop off the food). White Glove cannot speak to the privacy practices of these third parties, and we encourage you to read their privacy policies before deciding whether to use their services.
      2. WITH THE GENERAL PUBLIC WHEN YOU SUBMIT CONTENT TO PUBLIC FORUM. White Glove may receive information submitted to White Glove through public forums such as White Glove’s blogs, social media, and certain features on our network. When Users communicate with White Glove through those channels, your communications may be viewable by the public.
      3. WITH WHITE GLOVE’S SUBSIDIARIES AND AFFILIATES. White Glove shares information with our subsidiaries and affiliates to help us provide our services or conduct data processing.
      4. FOR LEGAL REASONS OR IN THE EVENT OF A DISPUTE. White Glove may share your information if we believe it is required by applicable law, regulation, operating agreement, legal process or governmental request, or where the disclosure is otherwise appropriate due to safety or similar concerns. This includes sharing your information with law enforcement officials, government authorities, airports (if required by the airport authorities as a condition of operating on airport property), or other third parties as necessary to enforce our Terms of Service, user agreements, or other policies, to protect White Glove’s rights or property or the rights, safety or property of others, or in the event of a claim or dispute relating to your use of our services. If you use another person’s credit card, we may be required by law to share information with that credit card holder, including trip information. This also includes sharing your information with others in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.
      5. WITH YOUR CONSENT. White Glove may share your information other than as described in this policy if we notify you and you consent to sharing of the information. This also includes sharing your information with other people at your request. For example, we may share your estimated time of arrival and location with a friend at your request, or your trip information when you split a fare with a friend.

9. CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

White Glove strives to provide Users and Drivers with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  1. E-MAIL SUBSCRIPTIONS. You can always unsubscribe from our commercial or promotional e-mails but we will still send you transactional and relational emails about your account use of the White Glove mobile application.
  2. TEXT MESSAGES. You can opt out of receiving commercial or promotional text messages on the White Glove app under Settings.
  3. PUSH NOTIFICATIONS. You can opt out of receiving push notifications through your device settings. Please note that opting out of receiving push notifications may impact your use of the White Glove’s mobile application (such as receiving a notification that your ride has arrived).
  4. PROFILE INFORMATION. While Users’ name will always be shared with Drivers and fellow White Glove you can delete any additional information that you added to your Profile at any time if you don’t want Drivers and Users to see it. Users will always be able to see Drivers’ names, rating, profile photos, and vehicle information.
  5. LOCATION INFORMATION. While you can prevent your device from sharing location information at any time through your Device’s operating system settings, User and Driver location is core to the White Glove’s mobile application and website and without it we can’t provide our services to Users and Drivers.
  6. EDITING AND ACCESSING YOUR INFORMATION. You can review and edit certain account information by logging in to your account settings and profile (Drivers may edit additional information through the Driver portal). If you would like to terminate your White Gloves account, please contact us with your request. If you choose to terminate your account, we will deactivate it for you but may retain information from your account for a certain period of time and disclose it in a manner consistent with our practices under this Privacy Policy for accounts that are not closed. We also may retain information from your account to collect any fees owed, resolve disputes, troubleshoot problems, analyze usage of the White Gloves Platform, assist with any investigations, prevent fraud, enforce our Terms of Service, or take other actions as required or permitted by law.

10. DATA SECURITY

White Glove has implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to White Glove is stored on our secure servers behind firewalls.

Unfortunately, the transmission of information via the internet is not completely secure. Although White Glove does our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

11. MISCELLANEOUS

  1. DATA SECURITY. We are committed to protecting the data of our White Glove Drivers and Users. Even though We take reasonable precautions to protect your data, no security measures can be 100% secure, and we cannot guarantee the security of your data.
  2. CHILDREN’S PRIVACY. White Glove is not directed to children, and we don’t knowingly collect personal information from children under 13. Pursuant to the Children’s Online Privacy Act, if we find out that a child under 13 has given us personal information, we will take steps to delete that information. If you believe that a child under the age of 13 has given us personal information, please contact us.
  3. CHANGES TO THIS POLICY. We may make changes to this Privacy Policy from time to time. If we make any material changes, we will let you know through the White Glove platform and mobile phone application, by email, or other communication. We encourage you to periodically review this policy for the latest information on our privacy practices. We will also make prior versions of our privacy policies available for review. As long as you use the White Glove platform and mobile phone application, you are agreeing to this Privacy Policy and any updates we make to it.
  4. CONTACT INFORMATION. Feel free to contact White Glove at any time with any questions or comments about this Privacy Policy, your personal information, our use and sharing practices, or your consent choices by contacting us.

12. JURISDICTION AND VENUE

By accessing White Glove’s website and mobile phone application, you expressly acknowledge and agree that any controversy or dispute that may arise out of or relating to this Privacy Policy, or any breach thereof, will be governed and determined in accordance with the Commercial Arbitration Rules of the American Arbitration Association. Any award or decision resulting from any such arbitration proceeding will be final and binding on you. This Privacy Policy shall be governed and construed in accordance with the laws of the United States of America and the State of Florida, excluding any laws regarding the conflict or choice of laws. Venue for any action or arbitration arising out of or relating to this Privacy Policy, or the breach thereof, shall be in Miami-Dade County, Florida, and you hereby consent to personal jurisdiction in Miami-Dade County.

13. TRANSLATIONS OF THIS PRIVACY POLICY

By accessing White Glove’s website or mobile phone application, you explicitly agree and acknowledge that while this Privacy Policy and all the terms set forth herein may be translated into a different language for your convenience, the only version of this Privacy Policy that shall be binding upon you will be this version, the version that is set forth in the English Language, and any translated documents, papers, agreements, or other communications of these terms in any other language shall have no legal effect and will not be binding upon White Gloves Lux Services, LLC. All translated documents or other translated communications provided to Users or Drivers by White Gloves Lux Services, LLC, will only serve the purpose of providing you with a general understanding of this Privacy Policy and you bear the full risk and responsibility if you agree to this Privacy Policy without consulting or otherwise obtaining the advice of an independent legal translator.

14. INCORPORATION OF TERMS AND CONDITIONS

Pursuant to this Privacy Policy and those terms set forth herein you acknowledge and agree that you have read in its entirety the Terms and Conditions provided to both Users and Drivers on White Glove’s website and mobile phone application and those Terms and Conditions are incorporated and made a part of this Privacy Policy and all those terms set forth therein.
